PHILIPSBURG--The Court of First Instance on Friday sentenced InselAir St. Maarten’s Station Manager Alonzo Alfred Hassell (51) and Ticket Office Manager Stephanie Badeau Brissett (29) for defrauding the airline of US $87,772 in mid-2016.<!--more-->



The Court found it legally and convincingly proven that the two former InselAir employees had committed embezzlement and money laundering independently from each other.

The station manager was sentenced to nine months in prison, six of which were suspended, on three years’ probation. He was also sentenced of payment of the maximum amount of NAf. 50,000 in damages. In case of non-compliance he will have to spend 365 days in prison. Hassell was also ordered to pay the legal fees involved with this legal procedure, which were estimated at NAf. 3,263.

During the June 22 Court hearing, the Prosecutor had called for six months, three of which were to be suspended, on two years’ probation, and payment of damages.

The Judge found it proven that Hassell had defrauded his former employer out of $67,144. The money was obtained from ticket sales. Part of the revenues was not deposited in the company’s bank account but disappeared into the manager’s and sales agent’s pockets.

The station manager had used the money to pay off his debts. The Court imposed a higher sentence, because he had been in a managerial position and had abused his responsibilities and his employer’s trust in him. The Judge said he would impose a more severe penalty, as the sentence should be a signal to society that such acts cannot be tolerated.

Badeau Brissett was sentenced to three months suspended, on three years’ probation, and 180 hours of community service. The Court found it proven that she had defrauded InselAir out of $20,628 following similar procedures. She was ordered to pay her former employer NAf. 37,700 in damages. She will also have to pay legal fees of NAf. 3,263.

If it were up to the Prosecutor, the ticket office manager would have been sentenced to 180 hours of community service, or 90 days imprisonment in case of non-compliance, and payment of NAf. 37,140 in damages.

Both defendants confessed they had taken money from their employer. The station manager took the money as he felt that he was underpaid, whereas the sales agent committed the alleged fraud to pay off her debts to several parties.

According to InselAir, which filed claims against its two former employees, Hassell defrauded them of $88,450 and Brissett of almost $30,000.

The Prosecutor’s Office and the Judge both used InselAir’s bank statements to determine the difference between the booked sales figures and the actual amount deposited in the account, and thus also the exact misappropriated amounts.

Attorney Safira Ibrahim’s pleadings on behalf of her clients were dismissed. She had contested the embezzled amounts, which, she had claimed, were considerably lower.

The lawyer also had made an appeal to the Court to consider her clients’ personal circumstances. The lawyer had called for a suspended sentence for Brissett and for community service for Hassell. She also had pleaded with the Court not to award damages as in her opinion the claimed amounts could not be proven.

    Als je de waanzinnige salarissen van de directieleden bij Insel zag (de grootste graaier was job hopper Andre Delger!) had de station manager nog gelijk ook.

    Maar Karel Frielink zag dat het goed was.
