The legal mandate of the Cft is to monitor the fiscal situation in the countries of Curaçao and Sint Maarten based on the Rijkswet financieel toezicht (Rft.)

On March 27, 2020, the Council of Ministers of the Kingdom of the Netherlands (RMR) invoked article 25 of the Rft allowing Curaçao a period of noncompliance with article 15, sub 1 of the Rft. Pursuant to this decision, the Cft was asked to advise the RMR on the liquidity needs of the countries for the month of April related to the Covid-19 outbreak.

With this request, Cft was accorded a task potentially in conflict with its legal mandate to report the extent to which the countries are complying with the Rft. In the Cft’s recommendation of April 7, 2020, to the RMR, it appears that these seemingly contradictory tasks have necessarily permeated the Cft’s advice.

On various points, the Cft’s recommendation seems guided by the committee’s legal function rather than the current urgent situation confronting the countries as a result of the Covid- 19 crisis.

The very fact that the RMR invoked article 25 of the Rft implies that the countries are allowed to deviate from the provisions of article 15 sub 1. Yet Cft overlooks this fact in its advice to RMR and continues to insist on Curaçao’s adherence to the provisions of article 15 sub 1 as contained in its previous recommendations.

The objective of Curaçao’s request to the RMR was to obtain the necessary funds to finance among others the extra healthcare expenditures needed as a consequence of the coronavirus outbreak and to provide assistance to the private sector to avoid an economic catastrophe.

Cft starts its response to RMR by acknowledging that the loss of revenue of the government of Curaçao is realistic based on the projections of the Central Bank. It emphasizes that those projections may actually be on the lower side since they were premised on the partial lockdown in effect at the time, and a total lockdown was promulgated on March 30, 2020. According to a recently issued Note, IMF estimates the 2020 financing fiscal gap for Curaçao at 22 percent of the GDP comprising both a shortfall in fiscal revenue and higher expenditure.

Cft Evaluation of the Curaçao request:

1.In its evaluation of the strategy underpinning Curaçao’s request for financing to the RMR, Cft states that the reallocation of the funds in the context of the Groeistrategie is inconsistent with previous agreements. In addition, the other measures announced by the government do not seem to get Cft’s approval. However, Cft’s evaluation is in contravention of the RMR’s decision to allow noncompliance of article 15 sub 1 for Curaçao.

2.Cft is further of the opinion that the measures proposed by the government should be more austere given Curaçao’s fiscal situation. The Cft is of the opinion that the private sector is not making sufficient sacrifice. Here again the committee overlooks the overriding objective of the government’s assistance program underpinning the financing request. The very fact that the sector will get 80% of the relevant minimum/SVB wage benchmark, implies in itself a sacrifice of at least 20%. The Cft departs from an economic contraction of 14,9% as projected by the Central Bank. By arguing for a much more austere program, Cft is increasing the downside risk for the Curaçao economy.

3.As support for small and medium- sized enterprises, the government proposes a credit facility to maintain productive capacity. In its evaluation Cft states that the sector itself has to make a larger contribution to the credit facility. The credit facility is based on the projected needs of the sector. To the extent that a small and mediumsized enterprise does not make use of the facility and uses its own funds or seeks access to other sources in itself implies a sacrifice by the sector. Arguing that the sector needs to make a larger contribution seems presumptuous.

4.Cft also is of the opinion that an additional supplement for the ‘onderstandtrekkers’ is not sufficiently argued since it does not seem to have a direct link to the current crisis. What Cft again overlooks is that in practice the ‘onderstandtrekkers’ allowance is a de facto supplement. Therefore, the economic standstill means that their primary income also would have dried up.

5.While Cft argues that Curaçao should not deviate from previous agreements when it relates to, among other things, the Groeistrategie, the committee does not maintain the same line of reasoning when it comes to the Begrotingskamer and Nationaal Planbureau, for example.

6.The Cft concludes its evaluation by arguing that Curaçao’s budgetary situation does not justify additional loans preferring instead a more austere package financed by creating the necessary fiscal room in the current budget. Here again, the Cft seems to argue against the RMR decision of March 27, 2020. Before the corona crisis, it was contended that social constraints prevented the creation of any additional fiscal room. By arguing now in a much more untenable situation for additional loans, Cft again seems to be insensitive to our current social economic realities.

Liquidity Needs:

1.In determining the liquidity needs of the government, Cft seems to condone the build-up of arrears when it refers to SVB since the committee does not have sufficient insights into the liquidity of SVB. The government should regularize its arrears. It should not depend on Cft’s insight into the liquidity position of any institution.

2.Cft is using this opportunity to advise the RMR to draw its attention to Cft’s previous advice rather than advise the RMR within the context of the current coronavirus crisis. This again reflects the conflicting situation for Cft as it had to advice the RMR on matter it previously as advised against.

3.The additional monitoring suggested by the government for this special program gets only lip service from the Cft. It is not clear to me why the Cft does not seem to support this additional audit function proposed by the government to monitor the rescue program.

  1. Het is goed dat het CFT het verzoek van de RMR heeft ingewilligd. Wie had dit anders op zo’n korte termijn kunnen doen? Vervolgens heeft het CFT blootgelegd dat er in de aanvraag allerlei posten waren opgenomen die helemaal niet passen in een dergelijk verzoek en/of niet waren onderbouwd. Dat doet de vraag rijzen: op wiens verzoek zijn die posten toegevoegd? Bijvoorbeeld de 15 miljoen aan achterstallige pensioenpremies 26,5 miljoen (!!) aan uitvoeringskosten en 30 miljoen ‘overig’? En nog 39 miljoen voor SVB. Had Nederland dit maar gewoon over moeten maken? En weer een nieuwe uitvoeringsorganisatie met directeur, secretariaat etc. Zijn er onder de ruim 4.000 ambtenaren echt geen mensen die dit kunnen organiseren? Het reguliere werk is nu toch deels weggevallen. Vigilante heeft ook een treffende analyse gepubliceerd vandaag. Dat doet je wel afvragen wie de ‘Ekspertonan den finansas públiko’ zijn die dit verzoek hebben opgesteld. Of was het de bedoeling dat Nederland alle financiële problemen die we toch al hadden even op zou lossen. En liefst nog als gift? Respect voor ‘Monchi’ maar die zullen we binnenkort ook wel niet meer op het eiland zien…

En al die tijd uw mond heeft gehouden, sterker nog; u heeft zelf ontkent dat… We hebben meer dan genoeg van u. Corrupte boeven zijn al lang niet meer welkom op ons eiland. You’re a big shame.   3. Rupsje nooitgenoeg aan het woord. Een parasiet is altijd op zoek naar iets om zijn honger te stillen. Als het geld bij zijn gastheer op is dan zal hij via de gemakkelijkste route aan nieuw geld proberen te komen. En wat is dan gemakkelijker dan geld van een ande4 te claimen.

  4. Het stuk bewijst dat het lichaam (Curaçao) is uitgeput, er valt niets meer te halen. De parasieten kunnen niets meer uit het uitgeputte lichaam halen. Maar als het lichaam overlijdt gaan de parasieten ook dood. Dus het zijn de parasieten die het hardst lopen te schreeuwen om voedsel voor het lichaam. Maar voedsel geven alleen zal het lichaam niet redden. Parasieten verwijderen en dan voedsel geven wel.
    Of is dit ook een doodsbedreiging?

  5. Mooie toelichting en uitleg over de rol van CFT, RMR en toepassing van de Rft.. Maar sinds het aanslag op de lokale economie door de maatregelen die genomen zijn om verspreiding van corona virus beperkt te houden, zal Curaçao niet aan ontkomen om moeilijke besluiten te nemen om zo het langer te kunnen uitzingen. Dus onderlinge solidariteit betekend ook dat voor een keer degene die meer hebben ruimhartiger moeten gaan worden met die nu minder hebben of niks meer hebben. Die bijdrage wordt is niet alleen van lokalen verwacht maar ook van Curaçaoënaars in het buitenland, alleen het volk red het volk. In Nederland zijn er ook meerdere particulier initiatieven op touw gezet want jammer genoeg komt niet iedereen in aanmerking voor de compensatie die door overheid wordt gegeven of voor de voedselbank. Dus geen land heeft het nu makkelijk, dus landgenoten tijd om ons zelf te bewijzen, op niemand en niks te wachten en ons steentje bij te dragen. https://www.ksd.cw/ned/

  6. De volgende die aansluit in het rijtje van Maria’s, Martina’s , Saleh’s, de Jongh El Hage’s en Rosaria’s en in de tijd dat ze aan zet waren NIETS gedaan hebben tegen wanbestuur en zelfverrijking, sterker ze deden ervaan mee….

  7. @KKC: waarom publiceren wij deze stukjes van deze charlatan? Waarom kan Tromp niet een stuk schrijven over:
    1. ondergang Girobank
    2. aanstaand faillissement ENNIA
    3. buitensporig beloningsbeleid CBCS
    4. gebrek aan depositie garantie stelsel
    5. verouderde regelgeving die achterloopt op internationale regelgeving (Basel, Solvency)
    Zou Tromp ook aan kunnen geven hoe zijn exorbitante salaris zich verhoudt met het totale gebrek aan tegenpresentatie?

  8. Meneer Tromp, corona is niet de reden van de financiële crisis. De corona heeft hem versneld en verergerd. De hele reden van een cvt is dat het eiland financiële problemen had en heeft. Waren die problemen er niet geweest was er geen cvt zo simpel is het. U, meneer tromp, was een van de hoofdrol spelers in de reden dat er een cvt moest komen. U die goed mee heeft gedaan met het nepotisme en inkomsten spel wat gespeeld wordt bij de overheid en zijn entiteiten. En dat is de reden voor de elende, meneer tromp, niet het cvt en eigenlijk ook niet de corona. Het is het parasitaire gedrag van de elite, meneer tromp en u was, of bent, deel van het probleem en zeker niet een deel van de oplossing.

  9. Weer een van de elite die de financiën en economie van het eiland kapot gemaakt heeft en nu loopt te gillen dat Nederland onrechtmatig handeld.
    Heeft iemand bewijs nodig dat patiënt curaçao eerst verlost moet worden van zijn lindwormen voor dat hij weer eten gaat krijgen?

  10. Als deze man geen 2 miljoen per jaar in eigen zak had gestoken bij CBCS hadden we er nu een stuk beter voorgestaan.

    Bij CBCS kotst iedereen ook Zus de Lannooy uit, een tiran van het type Tromp die niet alleen zijn nicht is maar ook werd aangesteld zonder vacature en zonder sollicitatieptoceedure en tegen een waanzinnig salaris, maar ook meteen na aanstelling 2 jaar vakantie mocht gaan vieren met behoud van dat riante salaris.

    Om van te kotsen dit alles.
